The JOY Index Privacy Policy

Thank you for using and interacting with our audience engagement software, including our downloadable and browser-based applications and facial analytics software used in event venues (the “Software”). This policy applies to your use of the Software. By using the Software, you are agreeing to this policy. If you do not agree to this policy, then you may not use the Software.
All references to “us” and similar words such as “we” and “our” (even if not capitalized) mean Bishop-McCann, LLC, a Missouri limited liability company. All references to “you” and similar words such as “your” (even if not capitalized) mean the individual using the Software.
Information We Collect
Anonymous Data
“Anonymous Data” means information that does not relate to an identified or identifiable individual and cannot reasonably be used to identify any individual. When you use or interact with the Software, we collect Anonymous Data about your engagement and enjoyment of the event you are attending. The Anonymous Data cannot be used to identify or re-identify you as a specific individual.
Personal Data
“Personal Data” means data that relates to an identified or identifiable individual. We do not collect Personal Data.
Sources of Information We Collect
We collect Anonymous Data directly from you, directly and indirectly from your use and interaction with the Software, and from third parties such as Immersion Science (getimmersion.com) and Zenus (zenus.ai).
Business Purposes for Collecting Information
We collect Anonymous Data to provide the Software to you, to enhance your experiences attending events, to track attendee engagement, and to create reports on aggregate attendee engagement.
How We Use Your Information
Anonymous Data
We may use Anonymous Data for any purpose not otherwise prohibited by applicable law, without your consent, without providing notice to you, and without providing compensation to you, including sharing and selling Anonymous Data to third parties, including sharing and selling Anonymous Data with/to our clients and customers (in all cases, only in an anonymous format).
Personal Data
We do not collect Personal Data. Accordingly, we will not have your Personal Data to use for any purpose.
Improvements to the Software
If you share ideas or suggestions with us regarding improving or modifying the Software, then we may use all the same without your consent, without providing notice to you, and without providing compensation to you.
Compliance with Legal Process
We may use and share Anonymous Data as follows: (a) to comply with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms, (b) to respond to lawful requests by public authorities, including to meet national security or law enforcement requirements, (c) to prosecute and defend a court, arbitration, or similar legal proceeding, (d) with our representatives and advisors, including attorneys and accountants, and (e) if we have a good faith belief that disclosure is necessary to investigate or prevent illegal or immoral actions.
Data Retention & Deletion
We do not have any obligation to store Anonymous Data for your benefit or for the benefit of any third party. We may delete all or parts of the Anonymous Data in our possession at any time, for any reason, without notice to you. We may retain Anonymous Data indefinitely. You may request that we delete your Personal Data from our systems, and we will comply with your request to the extent required by applicable law (however, please note that we will not have your Personal Data to delete anyway).
Rights Under the European Union’s General Data Protection Regulation (GDPR)
If you are a “Data Subject” under the GDPR, then in addition to the rights outlined elsewhere in this policy, you have the following rights: (a) to be informed about what data we collect and how we use it, to lodge a complaint with a supervisory authority that has jurisdiction over issues related to the GDPR, and (b) to the extent we have your Personal Data: to request access to it, to have us rectify it if it is inaccurate or incomplete, to have us erase, remove, or delete, it, to restrict our processing of it as provided in the GDPR, to data portability with respect to it, to object to certain uses of it as provided in the GDPR, to the extent you provided consent to our processing of it, to withdraw that consent at any time (however, such withdrawal will not be effective with respect to lawful processing based upon consent that occurred prior to your withdrawal), to ensure we only retain it for as long as necessary for the purposes outlined in this policy. Additionally, if you are a “Data Subject” under the GDPR, then we will not require you to provide consent for any unnecessary processing as a condition of entering a contract with us (and will require only the information that is reasonably required to enter a contract with you). Security
We use reasonable efforts to protect your information, especially your personally identifiable information and payment information. However, since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information you transmit to us. Further, it is your responsibility to protect the security of your account credentials.
Power to Amend This Policy
We may amend this policy at any time, for any reason, with or without notice to you, and your continued use of the Software after the amended policy is posted on the Software will constitute your acknowledgment and agreement to the amended policy. However, to the extent the amended policy materially alters your rights or obligations in this policy, the amended policy will become effective upon the earlier of (a) your continued use of the Software with actual knowledge of the amended policy, or (b) 30 days after the amended policy is posted on the Software.
